Clarisse Rochette Monnoury defended an individual before the Mulhouse Criminal Court in a case involving the unauthorized possession of a protected species.
She challenged the manner in which police officers had entered the defendant’s home, arguing that it was impossible to determine whether or not the entry constituted a formal search—a distinction with major implications regarding compliance with the Code of Criminal Procedure.
This plea for nullity was raised during the hearing, and the court immediately upheld it.
The charges were dropped, and the defendant left without having to answer a single question from the court regarding the merits of the case.
